§ 70-2. Waste disposal and recycling.

  • The town:

    (a)

    Shall provide and operate, within its boundaries, solid waste management facilities and appurtenances for the collection, management, recycling and disposal of solid waste, recyclable materials and other refuse of all of the residents and businesses of the town, and all other users of the town's water or sewer management facilities and appurtenances, without exception, whether or not such residents or businesses, or such other persons or entities, use the town's solid waste management facilities and appurtenances, or its collection, management, recycling and disposal services;

    (b)

    May provide and operate, outside its boundaries, solid waste management facilities and appurtenances for the collection, management, recycling and disposal of solid waste, recyclable materials, and other refuse of any person or business; and all other users of the town's water or sewer management facilities and appurtenances, without exception, whether or not such residents or businesses, or such other persons or entities, use the town's solid waste management facilities and appurtenances, or its collection, management, recycling and disposal services;

    (c)

    May contract with other localities to provide such services jointly;

    (d)

    May contract with others for supplying such services;

    (e)

    May contract with any locality or agency of the Commonwealth to provide such services for either entity;

    (f)

    Shall prohibit the disposal of garbage or recyclable materials in any place other than that provided or as may be approved by the town;

    (g)

    Shall charge and collect compensation for such services, at rates which shall be set by the town council, from all of the residents and businesses of the town, and all other users of the town's water or sewer management facilities and appurtenances, without exception, whether or not such residents or businesses, or such other persons or entities, use the town's solid waste management facilities and appurtenances, or its collection, management, recycling and disposal services;

    (h)

    Shall regulate the times and placement of waste and waste containers set out for collection;

    (i)

    Shall limit the use of waste containers provided or approved by the town to the disposal of garbage and other solid waste originating from within the boundaries of the town, and the unauthorized use of its solid waste management facilities shall constitute a Class 4 misdemeanor; and

    (j)

    May grant incentives to encourage recycling.
